Two great tastes that taste great together

Ok, I'm kidding. I'm referring to the 13th Amendment and abortion, two recent topics here that are addressed in an interesting manner by Glen Whitman, who argues that constitutionally, you either get the current abortion regime (if you're a strict property rights fellow) or one that requires compensation by the state ala the Takings clause.

My gut reaction is that I'm not sure it quite works that way (or, rather, that a strictly constitutional argument such as his is missing something important, a, how you say, a certain je ne sais quoi), but read the whole thing and decide for yourself.
